Terms of service
1. Scope
These Terms apply to all orders placed via the Mūhr Ceramics online shop. By ordering, the Customer agrees to these Terms and to German law.
2. Order and Contract
An order is a binding offer to purchase. The contract is concluded when Mūhr Ceramics confirms the order by email, or ships the goods. Mūhr Ceramics may refuse or cancel an order — including after confirmation — if a product is unavailable, if the order cannot reasonably be fulfilled, or if Mūhr Ceramics suspects resale, bulk-buying, or abuse of the ordering system. The Customer will be informed and any payment already made refunded without delay. Mūhr Ceramics may limit the quantity of any item a single Customer can order per drop.
3. Prices and Payment
Prices are shown and charged in the currency displayed at checkout (based on delivery destination); that currency and price form part of the contract. Conversion rates are set by our checkout provider (Shopify Markets) and may differ slightly from the Customer's own bank rate/fees, which Mūhr Ceramics has no control over.
- Germany: prices include German VAT (currently 19%).
- Switzerland, UK, Norway, USA, Canada, Australia: treated as export deliveries, exempt from German VAT under § 4 No. 1a / § 6 UStG (export documentation required). Prices shown are net of German VAT. Import duties/taxes on arrival are the Customer's responsibility (see Section 4).
Payment is due immediately at checkout. Mūhr Ceramics may correct obvious pricing errors; the Customer will be informed before processing and can choose whether to proceed at the correct price.
4. Shipping and Delivery
Shipping destinations, timelines, and customs/import responsibilities are set out in the separate Shipping Policy, part of these Terms. Mūhr Ceramics is a one-person studio operating in small batches. Dispatch times are estimates, not guaranteed deadlines; Mūhr Ceramics is not liable for delays caused by production, kiln, material, courier, or postal issues beyond its reasonable control. If a delay becomes significant, Mūhr Ceramics will inform the Customer and either party may withdraw from the contract for the delayed item, with a full refund.
5. Right of Withdrawal
A statutory 14-day right of withdrawal applies to Customers in Germany, Norway, and the United Kingdom, under applicable EU/EEA or UK consumer law. Full instructions and the model form are in the separate Return Policy, part of these Terms. For orders shipped to Switzerland, the USA, Canada, or Australia, no statutory right of withdrawal applies, and Mūhr Ceramics does not offer a general change-of-mind return for these destinations; Section 6 (damaged or incorrect items) still applies in full. Each piece is handmade; small variations in shape, colour, glaze, and texture are normal and not defects.
6. Damaged or Incorrect Items
If an item arrives damaged, defective, or incorrect, contact hello@muhrceramics.com with order details and photos where possible. This speeds resolution but doesn't limit statutory rights under Section 7, which apply regardless of when reported.
7. Warranty
Statutory warranty rights apply and remain fully unaffected by these Terms.
8. Liability
Mūhr Ceramics is liable without limit for intent, gross negligence, and any case where liability is legally mandatory (incl. injury to life/body/health). For slight (ordinary) negligence, Mūhr Ceramics is liable only for breach of a material contractual obligation (a duty whose fulfilment is essential to the contract and on which the Customer may reasonably rely), and in that case only for damage that is foreseeable and typical for a contract of this kind. Liability for slight negligence is excluded in all other cases, and liability for indirect or consequential damages is excluded to the extent legally permitted. Nothing here limits liability that cannot legally be limited or excluded.
9. Intellectual Property
All website content (images, text, graphics, logos, designs) belongs to Mūhr Ceramics or is used with permission, and may not be reproduced, distributed, modified, or used commercially without written permission.
10. Dispute Resolution
- Mūhr Ceramics does not participate in consumer arbitration board proceedings.
11. Governing Law
German law applies, except where mandatory consumer protection law of the Customer's home country says otherwise.
12. Severability
If any provision is invalid, the rest remains unaffected; the invalid provision is replaced by the applicable statutory rule.
